The effect of health insurance on workers' compensation filing: Evidence from the Affordable Care Act's age-based threshold for dependent coverage , Marcus Dillender Publication: Journal Articles. Barth, H.

Upjohn Institute for Employment Research, What lessons can we learn from the period of crisis and reform that reshaped most state workers' compensation systems in the s through the mids?

Conventional wisdom explains the problem as the need to balance adequate benefits for injured workers against affordable insurance costs for employers. In that scenario, expanding benefits in the s and early s pushed employers' costs upward to levels that interfered with states' economies—ultimately threatening workers' jobs. Some state governments tried to escape the tough trade-off between adequate benefits and affordable insurance by imposing stringent price controls on private workers' compensation insurers who were traditionally subject to rate regulation Danzon and Harrington But, as the story goes, this government "rate suppression" threatened to destroy state insurance markets as shrinking insurer profits led insurers to restrict insurance supply—moving many employers to deficit-ridden "residual market" pools that served as insurers of last resort.

This story concludes that the crisis was resolved when state governments enacted reforms that restricted benefits and deregulated insurance rate setting to make workers' compensation once again affordable for both employers and insurers—with necessary sacrifices from injured workers.

Perhaps the insurance industry is not as one executive claimed simply a passive messenger whose rates deliver the bad news about the costs of providing benefits Kerr but instead has the power to actively alter the costs of benefits to create a less harsh trade-off between workers' and employers' interests.

Of course, states in theory could provide both better workers' compensation benefits and lower insurance costs if they could reduce work injury claims whether in quantity or severity. One idea motivating the early-twentieth-century change from tort to workers' compensation was [End Page ] that a system of strict but limited employer liability for work accidents could provide better incentives for employers to minimize accidents.

In the s and early s, in contrast, advocates for workers' compensation reforms flooded the media and legislatures with the message that costs could be achieved only by strengthening incentives for workers and their doctors and lawyers to reduce injury claims. This message was illustrated with sensational stories of malingering workers bringing claims for "normal" or "subjective" aches and pains to avoid work or using workers' compensation benefits to cover impairments triggered in part by leisure activities, aging, or personal weaknesses.

Scholars supported the reform movement with reports of worker "moral hazard" based on data showing that increases in workers' benefit levels tended to bring an even greater increase in workers' benefit claims. But these criticisms of workers' effect on claims costs reveal the underlying problem that a supposedly "no-fault" system cannot avoid incorporating fault-based judgments about who is responsible for avoiding work accident costs McCluskey The focus on workers' cost-increasing behavior has diverted popular and scholarly attention from examining whether insurers may also engage in so-called "moral hazard.

In an important step toward exploring insurers' impact on workers' compensation costs, the authors of this book have undertaken a comprehensive and careful empirical analysis of two specific questions. First, does deregulation of workers' compensation insurance rate setting reduce employers' costs or workers' injury rates Project MUSE promotes the creation and dissemination of essential humanities and social science resources through collaboration with libraries, publishers, and scholars worldwide.

- Was passiert?

He знаю.
